In August 2026, Montenegro's parliament approved constitutional amendments designed to strengthen judicial independence and align the country's legal framework with EU requirements. The amendments address the core demands of Chapters 23 and 24, the two accession chapters that have consistently been identified as the hardest to close. By constitutionally embedding judicial independence, Montenegro removes the structural objection that has held these chapters open for years.

The amendments restructure the appointment and oversight of judges and prosecutors, reducing political influence over judicial appointments and establishing clearer separation between the judiciary and the executive branch.
